Discharged?

Hello, I claimed personal bankruptcy in 2004. I received a Conditional Order of Discharge in 2005 and still had to make $1000 of payments to the trustee. Since then I have met theses conditions (i.e. made my payments in full) and was discharged (this was in September 2006).

The problem is that my GST cheques are still being sent to my Trustee. They informed me that the Trustees had not been discharged. Why hasn’t my trustee been discharged? Are there still more things I have to do?

You don’t need to be concerned this is normal. There are 2 discharges in the bankruptcy process. The first, which is the bankruptcy discharge (the one you have obtained) simply means you have completed all of your obligations and have been cleared from the balance of your debts. The second, or trustee discharge, serves more of an administrative purpose. Prior to closing your file your trustee wait until all outstanding tax returns are assessed, clear up any outstanding issues, pay out all money in your estate as required by the Bankruptcy & Insolvency Act (typically this covers trustee fees and provides a small dividend to your creditors), and wait for these funds to clear the bank. A process that can take between 3 to 6 months depending on the time of year things happen. As a result you typically find 2 more GST cheques are sent to your trustee, who will in turn forward these monies to yourself.
