When dealing with student loans it is not the individual / organization collecting that is important, but how long it has been since one last attended school (i.e Section 178 (1)(g) of the Bankruptcy and Insolvency Act clearly stipulates that in order for a student loan to be cleared by discharged more than 10 years must have elapsed since the bankrupt ceased to be a full-time or part-time student).

Now there are some changes in the works. Bill C-55 will reduce this 10 year rule to 7, but we are unsure when / if these changes are actually going to be adopted. For more details about how and when this will come into effect please visit our student loan blog or contact licensed trustee.
