My husband and I are currently suing a company and the owner of said company for damages of over $6,000. Can the person we are suing declare bankrupcy while being sued in Small Claims Court and if they do declare bankrupcy do they still need to pay us the amount or do they get away with it

If the person you are suing files bankruptcy before, during or after the small claims court hearing then that debt will be erased when the person is discharged.
