hello, A good friend of mine recently got several credit cards, she was on welfare at the time. Now after several years those cards are maxed out and she can`t afford to pay for them and still eat or pay rent. she is still on welfare but is she able to file for bankruptcy and be discharged or is this not allowed for people who got cards while on welfare? Thanks in advance!

Yes, she is definately eligible to file for bankruptcy and be cleared from those debts. However the question is whether or not this is necessary.

As she is currently on welfare she may be in a position we refere to as judgement proof, meaning she doesn’t have to go bankrupt to get protection from her creditors because legally there is nothing outside of harrasing letters and phone calls that can be done by creditors to force payment i.e. assets a creditor cannot seize by going to court and getting a judgement because her income is to low).
