previous bankruptcy forgotten creditor

I received a discharged about 5 years ago but just realized I forgot to include a creditor in my bankruptcy.

I know this souds like a silly excuse but I honestly didn`t remember at the time. If i had remembered it I would have included it.

The problem is now I have this collection agency after me. Someone suggested that i go to my lawyer and have this creditor added to my bankruptcy. Can I still do this?

Technically speaking failure to list a creditor doesn’t mean that you owe this creditor the full amount of the debt.

As long as the debt occurred prior to the filing of a bankruptcy the way the law operates is that you are only required to provide this forgotten creditor the same recovery they would have received during your bankruptcy.

For more details on this you should contact your original trustee.
