I have a question about filing a about filing a consumer proposal. I live in Edmonton, don`t want to file bankruptcy, filed bankruptcy back in 1998 and don`t want to do it again.

Right now I am about 62k in debt. The problem, while I have my own bank account amy husband and I have a joint bank account that he uses not me. In that acount he has about 8000 in savings. Thi smoney has nothing to do with me, it was a gift from his dad that he simply put in that account. My question is will they be able to take this to pay off my debts.

None of my debts are joint debts and I really don`t want this to affect my husband.

As long as you can demonstrate that this money came from his father and no porition of them relate to you, then you shouldn’t have a major issue.

However, if you cannot clearly demonstrate this then 50% of the money in that account will pertain to you and likely have to be paid into the trustee.

In terms of a consumer proposal, this is a good alterantive, especially considering the the previous bankruptcy. Thie filing of mutiple bankrutpcies is possible, but I suggest where ever possobile you avoid as it is a much more involved and costly process.
