Can you declare bankruptcy if you have been incarcerated?

Whether or not you have been incarcerated has nothing to do with eligibility to file for bankruptcy.

Eligibility to file bankruptcy is based on the following criteria:

1. Must be currently living in Canada, have lived in Canada in the last 12 months, or currently own property in Canada;

2. You must not be currently in bankruptcy;

3. You must owe greater than $1,000.

As you can see the eligibility requirements are fairly simply and your incarceration shouldn’t have any impact on whether or not you qualify. At this point the best thing for you to do is to contact a local trustee to review what exactly is involved with the bankruptcy process.
