questions about bankruptcy

Hello, I have some questions for you, but I will first give you a bit of background.

- I am a single mother
- I work part time and make about $1,400 net per month
- I have 53,000.00 in unsecured debt (mostly credit cards)
I have no assets

I think I need to file a bankruptcy, but if I do will I still be able to get a student loan to finish my last 2 years of school (I have competed 2 years of my Bachelors degree, and have 2 years left)?

My second question is would I qualify for a 9 month discharge?

My third question, Does the trustee have to notify my workplace or where I live, or is the bankruptcy kept confidential?

In terms of the student loan, I am not completely familiar with all the things that are considered when they are looking at granting a student loan, but from the information we have been provided if you have completed two years of a program and are staying in the same program, then student loans will consider lending. However, if you are looking into a different program you are not guaranteed to be considered.

In terms of your second question, from the information displayed it appears as if you would qualify for the 9 month length of bankruptcy. This could change if your income changes.

Finally, the trustee rarely has to have anything to do with your employer. The only situations are if you have a garnishee in place that we need to stop, or if you fail to provide the proper income verification each month (i.e. pay stub), otherwise there is no need for your employer to be involved.
