previous bankruptcy

Hello, I have a problem.
My husband filed for bankruptcy in 2003.
The trustee has released himself, but not my husband.
My husband has never done anything to rectify this.
Now he needs to pay to re-open and go back into banckruptcy.

How does he do this?

What your husband must to is contact his original trustee. Now be advised in advance, this is not an easy process. First he will have to pay to get the trustee re-apponted. Then he will have to complete all of his other duties and account for any changes in circumstances since the filing of the bankruptcy. Once all this is done then an appliaction can be made to request a discharge, but realistically we know in advance the court will likley put a penalty in place that will have to be met before a discharge will be issued.
